NOTE: Be aware that I do not usually take public commissions anymore. I do create adopts, but I don’t do it as often anymore. Still if you find yourself purchasing from me, you are advised to read this thoroughly before doing so. If you do not read this, I am not liable for any misunderstandings or miscommunication. But if you do have questions you are free to ask. If you commission me, it is an automatic agreement of these terms, whether you read them or not. Thank you for your cooperation!

• I DO NOT DO BUSINESS WITH MINORS. If you are below the age of 18, commissioning me MUST be done with the permission of an adult over 18 years old (preferably a parent of guardian). You are responsible for getting said permission from a parent/guardian, you are responsible of yourself, your parents are responsible for you and your actions online. You are responsible and your parents are responsible for you. I take no liability for your wrongdoings or deception. This goes for both adopts and commissions (if I ever take a commission).• I have every right to refuse service, with or without explanation. I don’t owe an explanation to why I won’t give my services. This includes selling adopts or designs under my name.• I do not offer refunds. Be aware of this before buying from me.• I will ask for details about commissions before starting, any important details should be mentioned, whether I ask or not, it’s your Oc, any information is valuable and crucial for me to make your art. Please don’t change your mind, it can cause struggles in the process.• Lineart commissions cannot be colored in. Sketch commissions cannot be lined. (This goes for gifts too… it’s for my comfort. Please follow this rule.)• My wait time can range from days to months or longer. I know it’s a long time, but I’ve learned from my past mistakes that it’s just hard for me to manage time. If you aren’t comfortable with the idea of waiting, please don’t commission me. This does not mean every commission will take this long, but I want to cover my bases, since I do have a habit of procrastinating. Also i don't take commissions anymore so this one is just a slim chance because I’m trying to make sure anyone is aware.• I am allowed to make personal art and adopts in between my commissions if I take them.• You can post the art you commissioned from me, or the designs you receive from me, WITH PROPER CREDIT. Same goes for my designs.• All my designs must be properly credited to me on Toyhouse (Pinkavicious) and must NOT BE REMOVED for ANY circumstances.• My watermark cannot be removed. This is not negotiable, this is to prevent theft.• All transactions are in USD, via PayPal or Cashapp. (Learning Vgen and Kofi atm.)• You may not use your commission for commercial use/logos/making profit of any kind UNLESS you have discussed it with me beforehand (note that there will be a fee). Otherwise your commission is ONLY for personal use.• I am allowed to reuse ideas/lineart/sketches and any of the art I make (including from commissions), for Ych/bases/personal art.• If you wish to make personal products of the art (stickers for example), please ask me first!! I will not allow anyone to sell products of my own art without my specific written permission and agreement, as well a commercial fee.• I can give a slot to someone else if I see fit. This means if you are ghosting, or if the payment hasn’t gone through yet, I can choose somebody else.• You are not allowed to trace over or heavily reference the art I’ve made for you.• Except for User Content, all of the content on my Platform - including text, software, scripts, code, designs, graphics, photos, sounds, music, videos, applications, interactive features, articles, news stories, sketches, animations, stickers, general artwork and other content ("Content") - is owned by Myself or others I license Content from, and is protected by copyright, trademark, patent and other laws.• I reserve all rights not expressly described in these terms.• All trademarks, service marks and trade names are owned, registered and/or licensed by myself. You do not acquire a license or any ownership rights to any trademarks, service marks, or trade names through your access or use of the Platform or Content (from Pinkavicious).• You agree not to change or delete any ownership notices from materials downloaded or printed from the Platform. (From Pinkavicious).• To the extent Pinkavicious (Myself) approves the download or use of Content comprised of copyrights or copyrightable works. Pinkavicious grants you a limited, personal, non-transferable, non-sublicense, and revocable license to access and use such copyrights or copyrightable works solely for their intended purpose and solely for as long as Pinkavicious makes such Content generally available to the public. You do not acquire any ownership rights in the Content (including any trademarks or other intellectual property included in the Content), and all such Content is intended for personal, noncommercial use. Pinkavicious reserves the right to monitor your use and to alter or revoke this license or your access to the Content at any time and for any reason. Pinkavicious reserves the right to take down any Content in violation of these terms or Pinkavicious’ intellectual property rights. Pinkavicious allowing you this limited use does not constitute a waiver of any of Pinkavicious’ rights to the Content.• Outside of the specific usage rights granted to you by Pinkavicious in connection with the Platform, you agree not to use, copy, edit, translate, display, distribute, download, transmit, sell, create derivative works of, or in any way exploit any Content, including User Content, without Pinkavicious’ prior written consent. Unauthorized use of the Content may constitute a breach of copyright, trademark or other intellectual property laws and may subject you to criminal or civil charges and penalties.
